Looking for an Early Termination of Lease form for Alberta. Can`t see one in the critical forms section. Is there such a form?

Who is requesting the termination of the lease?

In general, if you write out an agreement yourself that addresses the who, what, when, where, and why, then you will be okay. Both parties need to agree to its terms, and sign it.

It should say the lease dated August 1, 2008, between X and Y for 1233 That St, My Town, is terminated as of May 14, 1935. Specify what is going to happen to the damage deposit, and any arrears that may exist.

In Alberta, If you have a fixed term lease, you cannot terminate the lease early. An example is a one year lease that runs from January 1 to December 31.That is why there is no form to download.

You can make an agreement with the Tenant to leave early, but beware of the clause in the RTA, The Tenant cannot give up his rights under the RTA.

If you have a month to month lease, then you must use one of the allowable reasons to terminate with 3 month notice, such as selling the property, or a family member moving into the property.

Thanks for the input. The form is for a lease that expires August 31st and by mutual agreement are looking at terminating August 15th. They bought a house with possession Aug. 1 and we want in a couple weeks early to repaint the place before the end of the month. Works for both sides so will probably just write out what Dan suggested. Thanks a bunch!
